PatentCenter vs ePCT -- contrasting design philosophies trending idea

Two things happened in the last 48 hours that come together.

First, I wanted to look at old bugs/requests.  I recall looking at a LONG list of issues in summer or fall 2020.  They're gone now.

Second, last week, the following conversation occurred on one of the email lists.   A attorney (indicated "user 1" via '>') had made an error, and the PTO's software hadn't caught it. Then the PTO's humans were so attached to... more »

Treat DOCX as "authoritative" -- bad idea made worse trending idea

The PTO's proposal of June 2 (86 Fed. Reg. 29571) to treat a DOCX as "defintive" doesn't solve the problem; it makes it worse. It proceeds from a misunderstanding of technology, and a misdiagnosis of the problem.

The DOCX format is not designed to provide the portability, uniformity, or interoperability that is essential to legal documents. As many letters to the PTO have explained (see, for example, https://www.uspto.gov/sites/default/files/documents/Comment_Seventy_Three_Patent_Practitioners_092719.pdf... more »

In Patent Center, nomenclature "application" vs "submission" trending idea

The nomenclature throughout PatentCenter is wrong and therefore confusing. The words "application" and "submission" are used by humans with two very specific and consistent definitions. Patent Center goofs it up. To humans (especially lawyers):

* An "application" is the thing that starts with filing a new application, has a serial number of the form xx/xxx,xxx, and persists for some years through multiple office actions,... more »

Substitute spec and preliminary amendment as DOCX trending idea

When filing national phase entry applications we routinely file a substitute spec and a preliminary amendment. It appears the DOCX format would be most useful if we could file the substitute spec and the claims of the preliminary amendment in DOCX format. But apparently at least the claims, being part of an amendment, would have to still be filed in PDF format. Clarification and best practices around use of DOCX for national... more »

Pre-Select document type based on filename trending idea

Some document types appear to automatically be pre-selected, for example an IDS. Others are not. It would be helpful if we could encode the document type in the filename. For example, recognize that documents which include the string "FRNREF" are foreign references. I can easily rename a large number of files on my side in a second. Selecting every reference and changing its type for "foreign reference" takes much longer.... more »

Solution to Error Messages?

I tried filing a 371 application in Patent Center a couple days ago. I received the following error messages trying to file just this one application. I tried everything, switching browsers (Chrome and Edge), starting over, cancelling submission. I was only able to successfully upload my ADS once. Once I got the ADS uploaded and moved to the next page, I encountered more upload error messages. I ended up back in EFS-Web.... more »

Save user defaults - such as default search field trending idea

Kudos to the Patent Center team for adding attorney docket number to the drop down as a search option on the home page. This is a welcome change! Thank you. It would be nice, though, if a user could save their default configuration such as their choice for that search field. For instance, if my searches in the home-page search field are almost always attorney-docket-number based, then it would be great if I could save... more »

Patent Term Adjustment

It would be an awesome add to have PTA days as a data point to return in application searching through the Workbench. PTA days are associated with patent expiration projects. Therefore, having the data as an option when reviewing groups of applications can be beneficial and minimize the number of application records that need to be physically opened for review.💡

Miscellaneous

Shorten the Electronic Fee Transmittal to 1 page for printing

After completing any filing in EFS that requires a fee payment, we print the Electronic Fee Transmittal receipt page for our bookkeeping. Unfortunately it includes a lot of white space and inapplicable blank items so that it always runs to 2 pages. It would save paper etc. if it would fit on 1 page, which seems achievable by omitting excess white space from the Title of the Invention field, blank lines, inapplicable blank... more »

Behind the scene processing of drawings trending idea

What is the "processing" of drawings which goes on behind the scenes which results in portions missing or being blacked out? It doesn't seem to be identical to the "processing" which occurs when using EFSWeb, as the same drawings filed in both systems appear in the file wrapper differently. Whatever processing Patent Center uses seems to distort the drawings even worse than EFSWeb. Is there any process we can use pre-filing... more »

Document Identifiers/Descriptions in File Wrapper Downloads

I would suggest the document descriptions be easier to read/understand on the EAR and in the file wrapper history. They are too long and difficult to read through, to find what you need. I think they should be more like the document descriptions in PAIR. Here's an example:

Patent Center = 21888_14242669_12-13-2017_ISSUE.NTF

Private PAIR = 2017-12-13 Issue Notification
