Pull Data into EPAS for Validation of Patent/Application Numbers

Now that we log into My.USPTO.gov when filing assignments as well, it should be easy to pull data from Public or Private PAIR into the Assignment system (EPAS) to ensure that assignments are correctly recorded.

During the validation step, the system should display the title and inventors of the patent/application numbers, so that the attorney can verify that the correct numbers were entered.

Erroneous recordations happen... more »

Passing docket numbers through to deposit account statements

When a fee is paid through Financial Manager from EFS, our docket number appears on our Deposit Account statement, making it easy to reconcile charges. But when a fee is paid through Financial Manager from PatentCenter, the docket number does not pass through to the Deposit Account statement. That makes no sense as Financial Manager is being used in either case. In any event, this needs to be fixed.

Pre-exam policies and procedures should be public

Most of the internal pre-examination procedures are opaque outside of the USPTO. It would be very help to have, in writing, on the USPTO website the exact internal procedures used to evaluate whether a Power of Attorney form, drawings, application data sheet, etc. are compliant. This would help reduce errors and ultimately reduce USPTO staff work load.

Submission of Petition for Foreign Filing License

Currently the Petition for Foreign Filing License must be submitted via FAX. The petition and accompanying documents must be faxed to the appropriate office and, according to the people who process the petitions, the documents are not received in their mailbox until the following day. Follow up to make sure the fax was properly received is thereby delayed.

The usual turn around time to receive the License is 2-3 business... more »

Leveraging Text (DOCX)

Keep paragraph numbers in issued patents

When applications are filed and published pre-grant, they have paragraph numbers, and those paragraph numbers are also used during prosecution to make any amendments to the specification When the patent issues, those paragraph numbers disappear and are replaced with column/line numbers. Wouldn't it be easier for the PTO and the reviewing public to have a consistent specification appearance by simply staying with the... more »

PTO web site improvement for frequent users

Practitioners and their assistants who used EFS, PAIR, Assignment recording, Maintenance fee payments, Fees, Forms, etc. frequently have to navigate clicking and scrolling through the PTO web site to get to the locations we need. How about a practitioner tab or shortcut that takes us straight to the most common links used by attorneys/agents/staff. Then we could make a single bookmark that takes us to Private PAIR,... more »

Acceptance/Rejection of AIA Compliant Declarations

Currently, it seems there is only a Notice issued if no Declaration is submitted, or if the Declaration is not proper.

1) We have received a lot of these Notices when a Declaration HAS been proper, just not the supplied USPTO form.

2) There is no indication on the Notice whether a Declaration is faulty or missing entirely, which would be much more helpful. (For example, if the Notice were to state a Declaration was... more »

Eliminate conflicting language in Notice to File Miss Parts

Although it is generally accepted that if you are filing a response to a Notice to File Missing Parts or Notice to File Corrected Application Papers via EFS that you do not need to submit a return copy, the Notice actually contains conflicting instructions (see attached screenshot). The standard language of the Notices should be updated to definitively state that if you are filing a response via EFS that no return copy... more »

Securing USPTO online access

Not Happy.

The Office's decision to eliminate the ability to review Public PAIR data while logged into Private PAIR is a huge step in the wrong direction. What you are essentially asking users to do is to have two versions of PAIR open in order to do their daily duties. I understand that data mining is a concern of the Office, however, the Customer Number practice was intended to help avoid access to unpublished applications... more »

Login Ineffective

We are finding more and more that there is a glitch that results in logins being ineffective, i.e., the login is not rejected, but Patent Center acts like it didn't happen. Specifically, the user is not shown the Workbench or any other non-public interfaces--even after they log in. It seems like it usually happens after a successful login and later logout--the non-public interfaces are shown for the initial log in, and... more »
