Drawings trending idea

The DOCX website claims drawings can be filed via docx, however every time I have tried to file drawings at the end of a docx, they always get labeled as part of the abstract. The document processing should get worried if an abstract is more than 1 page anyway, but how do you get drawings recognized?

part detection is sensitive to name of a style

Today I tried to upload a new application.  We were uploading the spec when we received the following error. "This document contains multiple application parts (specification, claims, and/or abstract). Please upload application parts separately."

The error went away when we changed the style called "Dan's claims" to "Dan's Spec style".

I am assuming that because the stylesheet had the word "claims" in it, the software... more »

Dependent claim incorrectly identified as independent claim

I just submitted an application today with 3/20 independent/total claims; when uploaded, Patent Center flagged it as having 4/20 independent/total claims.  It then filled out the fees due according to this claim count.  The culprit was claim 3, which recited:

3. The apparatus of either claim 1, wherein the.... (substantive material omitted since not public; underlining was added for this post).

The claim had started... more »

Treat DOCX as "authoritative" -- bad idea made worse

The PTO's proposal of June 2 (86 Fed. Reg. 29571) to treat a DOCX as "defintive" doesn't solve the problem; it makes it worse. It proceeds from a misunderstanding of technology, and a misdiagnosis of the problem.

The DOCX format is not designed to provide the portability, uniformity, or interoperability that is essential to legal documents. As many letters to the PTO have explained (see, for example, https://www.uspto.gov/sites/default/files/documents/Comment_Seventy_Three_Patent_Practitioners_092719.pdf... more »

Keep paragraph numbers in issued patents

When applications are filed and published pre-grant, they have paragraph numbers, and those paragraph numbers are also used during prosecution to make any amendments to the specification When the patent issues, those paragraph numbers disappear and are replaced with column/line numbers. Wouldn't it be easier for the PTO and the reviewing public to have a consistent specification appearance by simply staying with the... more »

"This document contains multiple application parts" errors

In a trial ".docx" filing of a pair of patent applications, we received several instances of the above "This document contains multiple application parts" error, flagged as a fatal error, all for the Specification part. (The Claims and Abstract sections were apparently acceptable.) Needless to say, we eventually filed both of these .pdf.

None of these errors indicated what specifically triggered this error, so what... more »

Identification of Intelligent Information Services reliance

Automation coupling with a Human subject matter requires a procedure identifying and verification of the connectivity between Intelligent Information Services and Human Interoperator Distributor. It is clear to see policy formation oversight has implemented strict procedures which enable "organizational" catalyst promoting aggressive disassembling of a targeted jurisdictional subject matter. This subject matter should... more »

Need far more material on equations in .docx filing

It appears the only information on acceptable equation formats is in "Quick_Start_Guide_DOCX_Intake.docx", as an off-hand reference to "Unsupported OLE Objects", which states:
"(Supported OLE Objects include Visio.Drawing.11, Equation.DSMT4, ACD.ChemSketch.20, ChemDraw.Document.6.0, Equation.3)"

The one used with most versions of MS Word is "Equation.3". "Equation.3" had not been maintained for a number of years.... more »

Template(s) would be helpful

It would seem helpful, to both the applicant and the Office, to have access to a .docx template that we can start from.

This could have acceptable fonts, type size, line spacing, margins, page numbering, correct headings and section breaks where required (such as for Claims, Abstract), suitable numbering for lines and paragraphs (if bold para. numbering in .docx will be a new requirement, currently optional per MPEP),... more »
